1. GENERAL

1.1 These terms and conditions govern the sale of goods from the online store.
1.2 By accepting these terms and conditions, the Buyer acknowledges having read and agreed to them.
1.3 In addition to these terms and conditions, the relevant laws of the Republic of Estonia and the European Union apply.
1.4 All content on the Seller’s website is protected by copyright. Unauthorized copying and use without the written permission of the Seller are prohibited. Unauthorized copying and use of the material without the written permission of the Seller is prohibited.
1.5 The Seller reserves the right to modify the Terms and Conditions.

2. PRODUCT AND PRICE INFORMATION

2.1 All prices are in Euros (EUR). Shipping fees are added and calculated at checkout.
2.2 Shipping fees vary based on location and chosen shipping method, with costs displayed at checkout.
2.3 Prices include applicable VAT for the buyer’s country. Buyers outside the EU may incur import duties and taxes, for which they are responsible.
2.4 The Seller is not liable for additional customs charges. Refusal of a package may result in a fee deducted from the refund.
2.5 Product details are provided alongside each item online. For further information, contact customer support with the product name and code.
2.6 Actual product colors may vary due to display settings.
2.7 All products are designed and provided by Birico with reputable origins and quality of silk-made products.
2.8 Online store (when applicable) prices and discounts may differ from those in retail stores. Prices online will not apply in retail or other partners’ stores and vice versa.
2.9 The Seller reserves the right to adjust prices. The conditions and prices valid at the time of the transaction apply.

3. ORDER PLACEMENT AND CONTRACT OF SALE

3.1 Add items to your cart and select a shipping method to view the total cost. Fill in the required details.
3.2 Changes to products and quantities can be made in the shopping cart.
3.3 Verify the selected products, sizes, colors and quantities before completing a purchase.
3.4 Ensure the accuracy of checkout information to avoid delays and additional costs. Notify us immediately of any errors.

3.6 An order confirmation is sent via email. Note that emails associated with the order may be filtered into spam or promotions folders.
3.7 The sales contract is established upon receipt of payment.
3.8 Payments are securely processed through Montonio, Stripe, or the buyer’s bank. The Seller does not have access to bank or credit card information.

3.10 In the event of stock errors, options include:
3.10.1 Equivalent replacement product;
3.10.2 Waiting for the product to be restocked (with updated delivery estimates);
3.10.3 Full refund.
3.11 If delivery is unsuccessful, the Buyer will be promptly notified, and all costs refunded within 14 days.

4. SHIPMENT

4.1 We offer worldwide delivery. Check available countries in the Shopping Cart. If your country is not listed, contact us to inquire about its availability.
4.2 Estimated delivery times and shipping methods are provided for more information.
4.3 Delivery times may be longer during peak periods such as Christmas and Black Friday or other national holidays.
4.4 The Seller is not responsible for delivery delays due to unforeseen circumstances after goods have been handed to logistics partners.
4.5 Delivery times vary by country, delivery method, and product availability in warehouses.

4.8 All orders are shipped from within the European Union.

5. RETURN POLICY

5.1 14-Day Return Policy: Products can be canceled and returned within 14 days of delivery without questions asked. The return period begins upon receipt of products by you or a third party (not the delivery service). Ensure items are returned or proof of return is provided within this period.

5.2 Return Conditions:

5.2.1 Only unused items can be returned in their original packaging with all tags attached due to health reasons. Any visible wear and tear or misuse may lead to refusal of the return.
5.2.2 To exercise the 14-day right of withdrawal, items must not be used beyond what is necessary to inspect their nature, characteristics, and functionality. If the goods have been used for purposes other than necessary to ascertain their nature, characteristics, and functioning lead to refusal of the return.
5.2.3 The right of withdrawal does not apply if the buyer is a legal entity. Business and special orders (e.g., custom-made items or wholesale or customized orders) are exempt from returns.
5.3 Return Costs: Return shipping costs are borne by the buyer unless the return is due to order non-compliance or incorrect or faulty items.
5.3.1. If the buyer explicitly chooses a delivery method other than the cheapest standard delivery method offered by the Online Store, the Online Store is not obliged to refund the consumer for any costs exceeding those associated with the standard delivery method. The Online Store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the online store has been significantly marked below the market price due to an error.
5.4 How to Return: Submit a return request via email ( or***@bi****.com ) or fill in PRODUCT RETURN APPLICATION form.
5.5 Responsibility: The buyer is responsible for the item until it safely reaches us. Ensure proper packaging to prevent damage during shipping.
5.6 Refunds: Refunds are processed promptly, within 14 days after we inspect returned items. Refunds are issued to the same account used for payment.
5.6.1 Full order returns include delivery costs.
5.6.2 Partial returns may not refund shipping fees if delivery cost was calculated per package, regardless of the number of products.
5.7 Price Errors: We reserve the right to withdraw from sales due to pricing errors and will issue full refunds for affected orders.
5.8. We have the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the online store has been significantly marked below the market price due to an error.

6. RIGHT TO MAKE A CLAIM

6.1 We are responsible for any non-conformity or defect in the goods sold to the buyer, which existed at the time of delivery and which manifests within two years from the delivery of the goods to the buyer. Within the first year from the delivery of the goods to the buyer, it is presumed that the defect existed at the time of delivery. It is the obligation of the Online Store to refute this presumption.
6.2 Defects must be reported within two months of discovery.
6.3 We are not liable for damages due to buyer fault or negligence, product misuse, or natural wear and tear during normal use. We are not liable for defects that occur after the delivery of the goods to the buyer.
6.4 If goods bought from the online store have defects for which we are responsible, we will repair, replace, or refund them accordingly.
6.5 Written responses to complaints are provided within 15 days.

7. DIRECT MARKETING AND PERSONAL DATA PROCESSING

8. SPECIAL ORDERS AND WHOLESALE

8.1 Birico is the original designer and distributor of reputable and quality silk-made products in Europe and globally. The company is established in Estonia. Learn more about our special offers and company.
8.2 If you wish to order a product in a larger quantity — e.g. resale and corporate gifts — please use the partnership form or contact our sales representative by email in**@bi****.com .
8.3. If you want to customize your order (special size/color products) please fill in the customization form.
8.4 The right of withdrawal does not apply to special/customized orders.

9. DISPUTE RESOLUTION

9.1 Buyer complaints about the online store should be emailed to in**@bi****.com or submitted by calling +372 5620 9955.
9.2 In case of dispute resolution failure between the Online Store and the Buyer, the consumer has the right to contact the competent supervisory authority, the Consumer Protection and Technical Regulatory Authority at Endla 10a, Tallinn 10122, via email: in**@tt**.ee . The Consumer Disputes Committee handles disputes between consumers and traders not resolved by agreement. The terms of the procedure and the application can be found and submitted here. Complaint reviews by the commission are free of charge.
